Use of this site and its services are covered by the herein stipulated terms of use. Please continue reading.

1.Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of GetDutyPulse.com and the DutyPulse tariff and trade compliance digest service (the "Service"), operated by DutyPulse ("DutyPulse," "we," "us," or "our"). By creating an account, subscribing to, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2.Description of the Service

DutyPulse provides subscribers with periodic email digests summarizing publicly available regulatory and trade-related information, including but not limited to notices published in the Federal Register, GovInfo, and related public government data sources. Digests are generated using a combination of automated data collection and AI-assisted summarization and are tagged with urgency indicators (RED/YELLOW/GREEN) intended to help subscribers prioritize their own review of the underlying source material.

3.Not Legal, Customs, or Trade Advice

The Service is an informational and news-monitoring tool only. It is NOT a substitute for advice from a licensed customs broker, trade attorney, or other qualified professional, and it does not constitute legal, customs, tax, or trade compliance advice of any kind.

6.Intellectual Property

The Service, including its underlying software, design, branding, and original commentary or summarization, is owned by DutyPulse and protected by intellectual property laws. Underlying government source material (e.g., Federal Register notices) remains in the public domain. Subscribing to the Service grants you a limited, non-exclusive, non-transferable license to use digest content for your own internal business purposes.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT DIGEST CONTENT IS COMPLETE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.

8.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUTYPULSE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY DECISION MADE IN RELIANCE ON DIGEST CONTENT — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

9.Indemnification

You agree to indemnify and hold harmless DutyPulse from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms, including any business decisions made based on digest content without independent verification.

10.Third-Party Services

The Service relies on third-party infrastructure to operate, including AI processing providers, transactional email delivery providers, and payment processors. We are not responsible for outages or errors originating from these third-party providers, though we maintain fallback data sourcing where reasonably practicable.

11.Termination

We may suspend or terminate your access to the Service for violation of these Terms, non-payment, or misuse. You may terminate your account at any time as described in Section 4.2.

12.Governing Law and Disputes

These Terms are governed by the laws of the State of New York ("Home State"), without regard to conflict-of-law principles.

12.1 Informal Resolution First

Before filing any claim, you agree to contact us at customer_support@getdutypulse.com and attempt in good faith to resolve the dispute informally for at least 30 days.

12.2 Binding Arbitration

If a dispute is not resolved informally, any claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, conducted on an individual basis only. Arbitration shall take place in, or be conducted remotely from, our Home State. Each party bears its own attorneys' fees unless the arbitrator determines otherwise.

12.3 Class Action Waiver

All claims must be brought in the parties' individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one party's claims.

12.4 Small Claims Carve-Out

Notwithstanding the above, either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies for that court's jurisdiction and remains on an individual basis.

12.5 Injunctive Relief

Nothing in this Section prevents either party from seeking injunctive relief in a court of competent jurisdiction in our Home State to protect intellectual property or confidential information pending arbitration.

13.Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
